CASE LAW

The term case law describes written rulings by judges in prior judicial proceedings. Judges are bound by the rules and reasoing set forth in case law in their jurisdiction, which they call precedent, just as they are bound by statutues, treaties, etcetera, when making new rulings. There is both federal and state case law. Judges must rule in accordance with precedent that has not been overrulled (thrown out, generally by higher courts), but they take case law from other jurisdictions under advisement. Archiving case law is beyond the scope of the Opticon's business objectives, but there are numerious websites where caselaw is available.
